CA ammo drama
This week federal judge Benitez ruled that California's ammo laws were unconstitutional, ordered that they not be enforced, and he did not allow a stay (continuing the laws to allow for appeal to 9th circuit court of ruining everything). Basically overturning requirement of background check for all ammo purchases, as well as requirement that ammo shipments must be to an FFL (which charges added fees).

As of Weds there was still confusion and ammo dealers were not yet shipping to buyers. But yesterday the CA DOJ clarified that Benitez's ruling currently stands (though of course they will appeal it).
Today for the first time I was able to order online from ammo stores who previously wouldn't sell to California*, and the orders will be shipped to my home. Huzzah! Others here may want to consider ordering now before California ties things up in court again.
*Many would not even ship to your FFL. I would guess this is because some buyers did not pass the background check and dealers had to deal with returns.

Re: CA ammo drama
Need this to apply to all states, will that happen or is this decision limited to California?

Thank you, but unfortunately there is a long way to go. We have long had a one-party state here*, with no provision for dissenting voices and no end in sight. In the future Judges like Benitez will never be appointed, or for that matter DA's who enforce laws. They say that California leads the nation, so those of your in other states please stay strong and make your voices heard.
*FWIW I'm an independent and see a lot wrong on both sides, not that my vote matters here

California can't perform basic essential functions like jailing criminals, removing vagrant camps, or enforcing border laws, but it can block constitutional rights in two days.

And now NY has introduced legislation to prefer criminal charges on all out of state purchases, for both the buyer and out of state seller.bruce martindale wrote:Need this to apply to all states, will that happen or is this decision limited to California?

Pretty sure it is a violation regarding restraint of trade and as well as Federal Interstate Commerce, but that never stops the anti-gun Socialists in NY.

When politicians pass legislation that knowingly violates the Constitution, they have broken their oath of office. While that crime goes punished, no amount of legal wrangling will result in a of rule of law.

Re: CA ammo drama
In a brief pyrrhic victory, I ordered quickly enough* (the window was ~1day) that two vendors were able to ship ammo to my home. The ruling was clarified on Thursday, I ordered Friday, and on Monday the appeal judges granted the stay - closing the door until the final appeal is decided (months, years, never, etc).
Of course this being California the UPS driver perched my heavy box - with "munitions" in the sender box - on a precarious perch, where 'they' never left anything before:

Pyrrhic because of principle. I don't mind paying a FFL to handle an order, or for that matter the background check (which takes seconds). I do mind being made to contort, grovel, supplicate, etc, to the local government just so they can grant rights that are already guaranteed by the constitution and were recently clarified in the Bruen case.

Re: CA ammo drama
California only. If the 9th upholds it, then only good law in the western states in that circuit. But I’m not sure if any other of those states have this issue. Even if another state in the 9th did have restrictions, those states would almost certainly argue that the restrictions are somehow different from the CA restrictions.bruce martindale wrote:Need this to apply to all states, will that happen or is this decision limited to California?

Good luck and I’m so glad that the people of California can rest safely again now that the stay is in place. The populace is protected from random Eley Club and CCI SV bullets ricocheting around on the Sunset Strip.
